These Termsof Service apply to services supplied by WebHosting4SouthAfrica (“WH4SA”, “we”, “us” or “our”).
By ordering, paying for or using a WH4SA service, the customer agrees to these Terms together with applicable product/service conditions.
1. Our Services
WH4SA provides web hosting, domain-related services, email hosting and related online services.
Our primary hosting products include:
HOST — R79/month
General cPanel web hosting.
BUILD — R99/month
A hosting environment with WordPress and Elementor Free prepared as a starting point.
SELL — R149/month
A hosting environment with WordPress, WooCommerce and Elementor Free prepared as a starting point.
Product features and prices are subject to the applicable service description at the time of order.
2. Customer Responsibility
Customers are responsible for websites, files, databases, email accounts, applications and content placed on their hosting account.
WH4SA provides the hosting environment and level of setup/support described for the selected product.
Unless specifically agreed otherwise, WH4SA does not build, operate or manage customers' websites or businesses.
BUILD customers remain responsible for building and managing their WordPress website.
SELL customers remain responsible for their store content, products, photographs, prices, orders, customers, shipping, taxes, payment-gateway account and day-to-day WooCommerce operation.
3. Hosting Resources And Fair Use
Shared hosting resources are shared between customers and are subject to reasonable resource and fair-use controls designed to protect platform stability.
Descriptions such as “unlimited” do not mean unlimited physical server resources.
WH4SA may intervene where an account causes excessive resource consumption, affects server stability, compromises security or materially impacts other customers.
Where practical, WH4SA will work with the customer to identify an appropriate solution.
4. Multiple Websites
Where a hosting account allows multiple websites or domains within one cPanel account, those websites share the resources allocated to that hosting account.
This is not reseller hosting and does not provide separate cPanel accounts or WHM unless expressly stated.
5. Billing And Payment
Services are billed according to the applicable billing cycle.
Payments are processed through available WH4SA payment methods, including PayFast.
Customers are responsible for ensuring invoices are paid by their due dates.
Non-payment may result in suspension or termination of the affected service, subject to applicable requirements.
6. Month-To-Month Hosting And Cancellation
HOST, BUILD and SELL are month-to-month hosting services.
Customers wishing to cancel must submit a cancellation request through a WH4SA support ticket.
Cancellation requests must be submitted at least 5 working days before the next renewal date.
There is no refund for an unused portion of an already-paid month.
Customers remain responsible for amounts already due before cancellation takes effect.
7. 30-Day Money-Back Guarantee
HOST, BUILD and SELL include a 30-day money-back guarantee.
The guarantee applies to the hosting service.
Domain registration, domain renewal and domain transfer fees are non-refundable.
No other standard WH4SA hosting charges are excluded from the guarantee unless clearly disclosed before purchase.
Nothing in these Terms removes rights customers may have under applicable South African law.
8. Domains
Domain registration, renewal and transfer services are subject to the rules and procedures applicable to the relevant registry and registrar.
A requested domain is not guaranteed until registration has successfully completed.
Customers are responsible for maintaining accurate domain information and ensuring domains are renewed when required.
Transfer procedures differ between domain extensions.
Domain registration, renewal and transfer fees are non-refundable.
9. Website Migration
Where WH4SA offers migration assistance, eligibility and scope must be confirmed before migration.
Migration assistance does not guarantee that every website, plugin, application, configuration or third-party service can be migrated without modification.
Customers should retain appropriate backups of important information before migration.
10. Backups
Where backups are included, they are provided as an additional recovery measure.
Customers remain responsible for maintaining their own copies of business-critical websites, databases, files and other important information.
WH4SA cannot guarantee that every backup will contain every item or that recovery will be possible in every circumstance.
11. SSL
Where SSL is included, availability and operation may depend on correct DNS, domain and hosting configuration.
Specialised or third-party SSL requirements may involve additional services or charges.
12. Email
Customers are responsible for lawful and appropriate use of WH4SA email services.
Email may not be used for spam, phishing, malicious activity or other prohibited conduct.
Email deliverability can be affected by third-party mail systems, filtering, reputation and recipient policies and cannot be guaranteed in every circumstance.
13. Acceptable Use
WH4SA services may not be used for unlawful, fraudulent, abusive or malicious purposes.
Prohibited use includes:
- malware or malicious code;
- phishing;
- spam;
- unauthorised access or attacks;
- copyright infringement;
- unlawful content;
- activities intended to compromise systems or networks;
- deliberate excessive resource consumption.
WH4SA may suspend or terminate services where reasonably necessary to protect customers, infrastructure or third parties, or to comply with legal obligations.
14. Security
Customers are responsible for maintaining secure passwords and protecting account credentials.
Customers running WordPress, WooCommerce or other applications are responsible for their website content, users, plugins, themes and other customer-managed software unless a service expressly states otherwise.
15. Third-Party Software And Services
WH4SA services may use or integrate with third-party services and software including cPanel, WordPress, WooCommerce, Elementor, SiteJet, payment gateways and domain services.
These remain subject to their respective providers' terms, functionality and availability.
Where Elementor is included, it is Elementor Free, not Elementor Pro.
WH4SA cannot guarantee that third-party products will remain unchanged or continuously available.
16. Payment Gateways And Online Stores
SELL provides the hosting and prepared WooCommerce environment described by WH4SA.
Customers contract separately with their selected payment-gateway provider and remain responsible for gateway approval, fees, configuration and compliance.
WH4SA does not operate the customer's business or act as merchant for the customer's online-store transactions.
17. Service Availability
WH4SA works to provide reliable hosting services, but internet-connected services cannot be guaranteed to operate without interruption in every circumstance.
Maintenance, upstream provider failures, internet routing issues, security incidents and circumstances outside WH4SA's reasonable control may affect availability.
Any specific uptime commitment is subject to the conditions applicable to that service.
18. Suspension And Termination
WH4SA may suspend or terminate services where reasonably necessary because of non-payment, prohibited use, security threats, abuse, legal requirements or serious breach of these Terms.
Where reasonably possible and appropriate, WH4SA will attempt to communicate with the affected customer.
19. Limitation Of Responsibility
To the extent permitted by applicable law, WH4SA is not responsible for indirect or consequential loss resulting from circumstances outside its reasonable control, customer-managed content/software, third-party services or misuse of a service.
Nothing in these Terms excludes or limits liability where doing so is prohibited by South African law.
20. Changes To Services And Terms
WH4SA may update products, prices, features and these Terms from time to time.
Material changes will take effect subject to applicable law and contractual obligations.
The current Terms will be published on the WH4SA website.
21. Governing Law
These Terms are governed by the laws of the Republic of South Africa, subject to applicable mandatory consumer rights.
